This Condition of Sale constitutes the entire agreement and understanding between you and us for the supply of physical products and downloadable digital products to you. Product Descriptions
Pattern Faculty-LK attempts to be as accurate as possible. However, Pattern Faculty-LK does not warrant those product descriptions or other content of any Pattern Faculty-LK Product and Services is accurate, complete, reliable, current, or error-free. We try our best to provide you with the correct information at all times. Human errors will be dealt with accordingly as and when it occurs.
Product Descriptions and Pricing
Pattern Faculty-LK attempts to be as accurate as possible. However, Pattern Faculty-LK does not warrant that product descriptions or other content of any Pattern Faculty-LK Service is accurate, complete, reliable, current, or error-free. If a product offered by Pattern Faculty-LK itself is not as described, your sole remedy is to return it in unused condition. However, all digital and downloadable products cannot be returned and once it is sold it is considered as a FINAL SALE by Pattern Faculty-LK.?? There is no return policy for any digital and downloadable product(s).
“List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on the Pattern Faculty-LK site and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on the Pattern Faculty-LK site.
Concerning items sold by Pattern Faculty-LK, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.
License and Use ??
Your purchase of any of our digital products constitutes our granting to you of a non-exclusive, non-sub licensable, non-transferable license to download and access that product for your personal use and reference, and print or convert the product to an image or vector format for your own storage, retention and reference (the ???purpose???). You agree that under no circumstances shall you use, or permit to be used, any product other than for the aforesaid purpose. For the avoidance of doubt, you shall not copy, re-sell, sublicense, rent out, share or otherwise distribute any of our digital products, whether modified or not, to any third party. You agree not to use any of our products in a way which might be detrimental to us or damage our reputation.
Intellectual Property
The products, whether modified or not and all intellectual property and copyright contained therein, are and shall at all times remain our sole and exclusive property. You agree that under no circumstances, whether the product has been modified or not, shall you have or attempt to claim ownership of any intellectual property rights or copyright of the product(s).
Return Policy (Digital ??? downloadable Products)
Once a product(s) has been purchased by you, no right of cancellation or refund exists due to the electronic nature of DIGITAL PRODUCTS. Any refunds shall be at our sole and absolute discretion. You agree that under no circumstances whatsoever shall you initiate any chargebacks via your payment provider. You agree that any payments made by you for any of our products are final and may not be charged back.
All our Digital patterns are provided ???as is??? basis along with the basic printing and sewing instructions so that your garment turns out well. Please remember that the actual fitting of clothes sewed depends on the material chosen and sewer???s skills.?? Therefore, it cannot be considered a reason for the refund. And also, please note that the basic sewing instruction pamphlet provided to you at no extra charge and should not be regarded as a sewing master class.
Warranties and Liability
We make every effort to ensure that our products are accurate, authoritative and fit for the use of our customers. However, we take no responsibility whatsoever for the suitability of the product, and we provide no warranties as to the function or use of the product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for a particular purpose. You agree to protect us against all liabilities, claims, demands, expenses, actions, costs, damages, or loss arising out of your breach of these terms and conditions. Furthermore, we shall not be liable to you or any party for consequential, indirect, special or exemplary damages including but not limited to damages for loss of profits, business or anticipated benefits whether arising under offence, contract, negligence or otherwise whether or not foreseen, reasonably foreseeable or advised of the possibility of such damages. ??This agreement supersedes any prior agreements whether made in writing, orally, implied or otherwise.
Update of this Condition of Sale
We reserve the right to modify this Condition of Sale at any time, so please review this page frequently. Pattern Faculty-LK may, in its sole discretion, change or modify this Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Subscribers (customers, vendors, sellers and visitors) upon posting of the modified Agreement HERE.?? You are responsible to read this document regularly to ensure that your use of the Service remains in compliance with this Agreement. If you continue to use our services or websites following an amendment to this Agreement, you will be deemed to have consented to the updated Condition of Sale of Pattern Faculty-LK. If our store is acquired or merged with another company, your information may be transferred to the new owners so that they (we) may continue to sell products to you.
